The city of Indianola appears to be headed to court to defend itself pursuant to allegations made by a homeowner that it failed to fully vet the credentials of an Arkansas contractor hired to construct her home.
A hearing before Judge W. Ashley Hines has been set for 10 a.m., June 25, in a Washington County Courtroom.
Cleveland attorney Mary McKay Lasker, acting as attorney for the defendants, responded to a notice of hearing and a request to appear, dated March 29.
The plaintiff, Walterine Martin is suing the city, Elvis Pernell, Pernell’s Plumbing Service, A.L. Haney Construction and its owner Arthur L. Haney of Lake Village.
Legal documents filed in September of 2017, in the circuit court of Sunflower County, by the Lucille Street resident alleges negligence on the part of Pernell and the city for issuing Haney a construction permit with full awareness that he was not licensed in the state and breach of contract against Pernell’s plumbing service and Haney for failure to fully and adequately carryout the terms of their contracts.
In addition to a trial by jury, Martin is requesting $200,000 in damages for breach of contract, out of pocket expenses, punitive damages, pain and suffering, and mental anguish.
