NOTICE OF SALE

     WHEREAS, on May 11, 2011, Leo Patrick Flemming executed a certain Deed of Trust to Cousie Giglio, Trustee, in favor of Guaranty Bank & Trust Company as beneficiary; said deed of trust appearing of record as Instrument No. 2011003398, of the deed of trust records as contained in the office of the Chancery Clerk of Sunflower County, Mississippi; and

     WHEREAS, W.C. Trotter, III was appointed Substituted Trustee in the Deed of Trust aforementioned by instrument executed and recorded August 27, 2012, as Instrument No. 2012004535 in the office of the  Chancery Clerk of Sunflower County, Mississippi; and

NOTICE IS HEREBY GIVEN that the Board of Supervisors of Sunflower County, Mississippi, is considering adoption of an Ordinance requiring application for and acquisition of a building permit prior to construction of new improvements to real property and/or additions to existing improvements to real property within specified areas of Sunflower County, Mississippi.   A public hearing will be conducted in the Supervisors’ Room of the Sunflower County Courthouse, Indianola, Mississippi, on Tuesday, January 16, 2018, at 10:00 o’clock, a.m., at which time citizens and parties in interest shall have an opportunity to comment and provide input on such proposed Ordinance prior to its adoption.  All interested citizens are encouraged to attend and comment.

Each proposal must be accompanied by a bid guaranty in the amount of five (5) percent of the total amount of the bid.  The bid guaranty may be by certified check or bid bond made payable to Mississippi Delta Community College.

Bids may be held by the Mississippi Delta Community College for a period not to exceed 60 days from the date of the bid opening for the purpose of evaluating bids prior to award of contract.

The Owner reserves the right to waive any informalities or to reject any and all bids,

Each bidder must deposit with his bid, security in the amount, for and subject to the conditions provided in the Notice and Instructions to Bidders.

Bidders must comply with Section 3, of the HUD ACT of 1968, the Davis-Bacon Act, the Anti-Kickback Act, the Contract Work Hours and Safety Standards Act, and the President’s Executive Order No. 11246.

All bids submitted in excess of $50,000 by a prime or subcontractor to do erection, building, construction, repair, maintenance, or related work, on public projects must comply with Section 31-3-21, Mississippi Code of 1972, must have a “Certificate of Responsibility” license.  Where applicable, the foregoing certificate number and license number must be indicated on the exterior of the sealed bid envelope before it can be opened.

Certification of Non-Segregated Facilities: The Contractor must complete the Certification of Non-Segregated Facilities included in the specifications.

PUBLIC NOTICE

    NOTICE is hereby given that the Board of Supervisors of Sunflower County, Mississippi, will consider abandonment of a portion of Baughman Road within Sunflower County, Mississippi, a public road of Sunflower County, Mississippi.  The geographic boundary of the portion of such road to be abandoned is described as follows:

    From the Bolivar County Line in Section 18, Township 23 North, Range 4 West to the South line of Section 16, Township 23 North, Range 4 West, Sunflower County, Mississippi, and

    Prior to abandonment of such public road, the Board of Supervisors will hold a public hearing upon the question of such abandonment.  The date for such hearing has been established as Tuesday, January 16, 2018, at 10:00 a.m., in the Board of Supervisors’ Room at the Sunflower County Courthouse in Indianola, Mississippi.

    Any citizens interested in such proceedings are invited to attend such public hearing and to present any objections, comments, materials, or other information upon the question of abandonment of such portion of Baughman Road as a public road of Sunflower County, Mississippi.
