Each bidder must deposit with his bid, security in the amount, for and subject to the conditions provided in the Notice and Instructions to Bidders.

Bidders must comply with Section 3, of the HUD ACT of 1968, the Davis Bacon Act, the Anti Kickback Act, the contract work hours and safety standards act, and the Presidents Executive Order No. 11246.

Section 3 of the Housing and Urban Development Act of 1968 requires that the Town and contractors participating in CDBG projects give opportunities for job training and employment to lower income residents of the Section 3 area that is described below:

Section 3 also requires that “to the maximum extent feasible: contracts for work in connection with Section 3 covered projects be awarded to business concerns that are located in or owned in substantial part by persons residing in the Section 3 area.

The Section 3 area is defined as follows: The Town limits of the Town of Doddsville.

All bids submitted in excess of $50,000 by a prime or subcontractor to do erection, building, construction, repair, maintenance, or related work, on public projects must comply with Section 31-3-21, Mississippi Code of 1972, must have a “Certificate of Responsibility” license, Where applicable, the foregoing certificate number and license number must be indicated on the exterior of the sealed bid envelope before it can be opened.

Certification of Non-Segregated Facilities: The Contractor must complete the Certification of Non-Segregated Facilities included in the specifications.

NOTICE OF SALE

Whereas, on September 26, 2016, Stanley Johnson, Sr. executed a certain Deed of Trust to Cousie Giglio, Trustee, in favor of Guaranty Bank & Trust Company as beneficiary; said deed of trust appearing of record as Instrument No. 2016005569, of the deed of trust records as contained in the office of the Chancery Clerk of Sunflower County, Mississippi, and

Whereas, W.C. Trotter, III was appointed Substituted Trustee in the Deed Of Trust aforementioned by instrument executed and recorded November 8, 2017, as Instrument No. 2017005392 in the office of the Chancery Clerk of Sunflower County, Mississippi; and

Whereas, default having been made under the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said debt, Guaranty Bank & Trust Company, Belzoni, Mississippi, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sum due thereunder, together with attorney’s fees, trustee’s fees and expenses of sale:

That certain lot or parcel of land lying and being situate in the City of Indianola, Sunflower County, Mississippi, and being more particularly described as follows:

Begin at the SE corner of Lot 15, Block 1 of the Original Town (now City) of Indianola, MS; run thence North 76° West 30 feet; thence North 14° East 70 feet; run thence South 76° East 30 feet; thence South 14° West 70 feet to the point of beginning, and being a parcel of land 30 feet East and West by 70 feet North and South off of the East side of said Lot 15 in said block, together with all improvements thereupon situate, hereditaments and appurtenances thereunto belonging or in anywise appertaining.

Lot 14, Block 1 to the Original Town (now City) of Indianola, as mapped and platted by C.T. Bookout, Surveyor, on file in the office of the Mayor and Board of Aldermen of said City. Subject however, to all rights-of-way easements for sewer and water lines and all public utilities, more especially the right-of-way easement dated 10/7/30, recorded in Book J-*, Page 257, from W.P. Craig to Mississippi Gas & Electric Company over said property.

Lots 12 and 13 Block 1 to the Original Town (now City) of Indianola as mapped and platted by C.T. Bookout, Surveyor, on file in the office of the Mayor and Board of Aldermen of said city, being more particularly described as follows:

Begin at the point of intersection of the North line of Main Street and the East line of Front Street; run thence in an Easterly direction along the North line of said Main Street 95 feet to the point of beginning; run thence North 14 degrees East to the center of Indian Bayou; thence South 76° East along the center of Indian Bayou 80 feet; thence South 14° West to the North line of said Main Street; thence North 76° West along the North line of Main Street 80 feet to the point of beginning, it being the intention to convey the Shepard Hotel property.

Subject, however, to all rights-of-way easements for sewer and water lines and all public utilities, more especially the right-of-way easement dated 10/7/30, recorded in Book J-8, Page 257, from W.P. Craig to Mississippi Gas & Electric Company over said property.

A Strip of land off the North end of Lot 14 in Block 1 of the original town (now City) of Indianola, MS, more particularly described by metes and bounds as follows:

Beginning at a point on the East line of said block a distance of 5 feet North of the North line of the building as presently located on said property and being the Southeast corner of the property herein intended to be conveyed; run thence in a Westerly direction parallel with and 5 feet from the North line of said building to the West line of said lot and the Southwest corner of the property herein intended to be conveyed; run thence North along the West line of said lot to the center of Indian Bayou and the Northwest corner of the property herein intended to be conveyed; run thence in an Easterly direction along the center of said bayou to a point due North of the point of beginning and being the Northeast corner of the property herein intended to be conveyed; run thence South along the East line of said lot to the point of beginning.

Subject, however, to any right-of-way easements for sewage lines, gas lines or other rights-of-way, and more especially a right-of-way given to the Mississippi Power & Light Co. on 10/13/30, recorded in Book J-8, Page 261.
